1. General Information

The website and mobile application of Bachpankart (collectively, the "Site" or "Website") are operated by INNOWINDS TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, with its registered office at A-303, J M ORCHID APARTMENT, SECTOR-76, NOIDA, Gautam Buddha Nagar, Uttar Pradesh, India, 201301, for the online retail of kidswear and related products. Your use of the Site, services, and tools is governed by these Terms of Use ("Terms"). If you place an order on the Site, you are also subject to policies applicable to that transaction, including our Privacy Policy, which is incorporated by reference.

For these Terms, "You" or "User" means any natural or legal person who uses the Site, whether or not registered. "We", "us", or "our" refers to INNOWINDS TECHNOLOGIES PRIVATE LIMITED and Bachpankart.

Accessing, browsing, or otherwise using the Site indicates your agreement to these Terms. Please read them carefully before proceeding.

Products and information on Bachpankart constitute an invitation to offer. Your order is your offer, subject to these Terms. We may accept or reject your offer at our discretion. If you provide a valid email address, we will notify you when we receive your order and again when we confirm details for processing. Our acceptance occurs when the ordered product(s) are dispatched. No act or omission before dispatch constitutes acceptance.

Membership eligibility

The Site is available only to persons who can form legally binding contracts under applicable law. Persons incompetent to contract under the Indian Contract Act, 1872, including undischarged insolvents, are not eligible. You may use the Site only if you are 18 years of age or older. We reserve the right to terminate membership and refuse access if we discover you are under 18. For business entities, you represent that you have authority to bind the entity to these Terms.

Unless stated otherwise, materials on this website are directed at users accessing from India. We make no representation that products or services are appropriate or available outside India. Users accessing from outside India are responsible for compliance with local laws. We deliver products within India only and are not liable for claims relating to orders placed from outside India.

Unless product-specific terms apply, these Terms supersede prior representations or agreements and prevail over conflicting terms in any order. By using Bachpankart, you agree to be bound by these Terms.

Modifications

We may discontinue or modify these Terms and our Privacy Policy at any time without prior notice. Changes may include additional fees or charges where permitted by law. Modifications are effective when posted. We encourage you to review these Terms periodically. Continued use after changes constitutes acceptance of the modified Terms.

2. Account and Registration

You are responsible for keeping your account credentials confidential and for all activity under your account. We are not liable for loss arising from failure to protect your account or password. Contact us immediately if you suspect a breach. If we believe there is likely misuse or a security risk, we may require a password change or suspend your account without liability to us.

You agree to:

1. Provide true, accurate, current, and complete registration information as prompted on the Site.
2. Maintain and promptly update registration data. If information is untrue, inaccurate, incomplete, or not current, or if we have reasonable grounds to suspect this, we may suspend or terminate your account and refuse access to the Site.
3. Notify us promptly if you change the mobile number used for registration, verification, or communication. If you fail to update your account and a number is reassigned, we are not responsible for misdirected communications or access issues. After successful OTP or equivalent verification by a new user of that number, we may treat that user as the lawful owner of the number for account purposes.

Promotional offers and discount policies may be modified, suspended, or withdrawn at our sole discretion at any time.

3. Pricing, Promotions & Coupon Codes

Pricing information

We endeavour to provide accurate product and pricing information; however, typographical errors may occur. Price is confirmed only after you place an order. If a product is listed at an incorrect price or with incorrect information, we may refuse or cancel the order at any stage before delivery. We may contact you for instructions or cancel and notify you. Unless the product has been dispatched, your offer is not deemed accepted. If we accept your order, payment may be processed before dispatch. If we cancel after payment, the amount will be reversed per your payment method and bank timelines.

Promotion offers

For returned or undelivered orders, whether in part or in full, you may not remain eligible for the offer used on the original order. Refunds will not include the benefit of such offers. For offers such as "Buy 2 get 1 free", all items in the offer must be returned as purchased. Refund or replacement is initiated only after all related products are returned.

Free samples or gifts included with eligible orders are not eligible for return, replacement, or refund. Free gift offers depend on offer criteria after coupons and before applicable taxes, and are available while stocks last.

Coupon codes & cart offers

From time to time we share coupon-based discounts. To prevent misuse, the following apply unless otherwise stated for a specific offer:

1. Offers apply only when the coupon or cart offer is applied at checkout.
2. Offers are valid until the communicated end date or until stocks last, whichever is earlier.
3. Certain products, categories, or brands may be excluded from specific offers; exclusions will be stated with the offer.
4. Unless stated otherwise, one use per user per household per offer.
5. Coupons cannot be combined with other coupons or site-wide offers unless explicitly allowed.
6. The stated coupon discount or the product discount shown on site, whichever is higher, applies unless otherwise mentioned.
7. Personalised coupon codes are valid only for the intended recipient user.
8. We may change coupon terms at any time without prior notice.
9. Shipping and cash-on-delivery charges apply on the net payable amount after the coupon unless stated otherwise.
10. Cashback coupons, where offered, are subject to conditions stated with the cashback offer.
11. Offers apply only to listed sizes and colours on the promotional page unless stated otherwise.

Gift certificates

Where gift certificates are offered:

• Gift certificates are delivered electronically unless otherwise stated.
• You must have a Bachpankart account to redeem a gift certificate.
• Each gift certificate has a unique code entered at checkout.
• Only one gift certificate may apply per order unless we state otherwise.
• Gift certificate balance may be combined with another payment method; gift certificate value is applied first.
• Unused gift certificate value is not redeemable for cash.
• Lost or stolen gift certificates are not replaceable.
• Balance may be used across multiple purchases until expiry.
• Gift certificates are redeemable for orders shipped in India only.

Gift wrapping

• Gift wrap is available only on selected products at checkout, where offered.
• External packaging does not show pricing or payment details; original product MRP tags may remain on items inside.
• Discounts and coupons do not apply to gift wrap charges.
• Gift wrap charges are non-refundable if you return the order.

4. Transactions & Cancellation

Minimum order value

Unless stated otherwise at checkout, a minimum order value may apply before shipping, COD, or other charges. The applicable minimum will be shown in your cart before you confirm the order.

Convenience fees

We may levy a convenience or service fee on orders where disclosed at checkout. Such fees support platform operations and are generally non-refundable once products are dispatched, except where required by law or our returns policy.

Credit card and payment details

You agree that payment details you provide are correct, accurate, and that you are authorised to use the payment method. You must not use a card or account not lawfully owned by you. We may share details with third parties only for fraud verification or as required by law. We are not liable for card fraud; liability for fraudulent use rests with you, and you must prove otherwise if disputed.

Fraudulent or declined transactions

In case of fraudulent use of the Site, we may recover costs of goods, collection charges, and legal fees from persons concerned and initiate legal proceedings. Product returns are subject to verification. Where discrepancies are found after internal assessment, we may decline refunds or adjust amounts on future orders per our policies.

Cancellation by the customer

If we receive cancellation before shipment, we will cancel and refund the full amount paid. Orders already shipped cannot be cancelled through the Site; please refer to our Returns, Refunds & Exchange Policy.

Cancellation by Bachpankart

We may refuse or cancel any order at our sole discretion, including for quantity limits, pricing or product information errors, or issues identified by our fraud-prevention processes. We may request additional verification before accepting an order. If an order is cancelled after your card or account is charged, the amount will be refunded through the original payment method or credited as store credit where applicable. You agree not to dispute our decision regarding cancellation made under these Terms.

Payment

While using payment methods offered on the Site, we are not liable for loss or damage arising from decline of authorisation, preset bank limits, payment gateway issues, or other reasons beyond our control. All payments must be in Indian Rupees acceptable in India. We do not accept other currencies for purchases on the Site.

Before shipping, we may request supporting documents (such as government-issued ID and address proof) to verify ownership of the payment instrument. This supports a safe shopping environment for all users.

5. Guidelines for Writing Product Reviews

Reviews and ratings may be submitted only by verified buyers who have purchased and received the product.

When writing a review, please:

• Be precise, specific, and unbiased so other customers can make informed choices.
• Provide complete and accurate information; incomplete details may confuse others.
• Focus on what you liked or disliked about the product and why.
• Proofread before submission.

We may exclude reviews that include:

• Promotional content, phone numbers, or unrelated advertising.
• Information not about the product (e.g. delivery experience only).
• Inaccurate product information.
• References to other retailers, pricing elsewhere, or personal contact details.
• Copied text from other sources.
• Comments on other users' reviews.
• Foreign-language content, off-topic, or obscene material.
• Irrelevant or misleading user identifiers.

Allowed characters in review title and text include letters (A–Z, a–z), numerals (0–9), and common punctuation and symbols.

User-submitted images and content

By submitting product images, reviews, feedback, or other content ("User Content"), you agree that:

• You retain ownership but grant Bachpankart a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, display, and distribute such content for business and operational purposes.
• We may use submissions for product quality, fraud prevention, customer experience, marketing, and legal compliance.
• You have the right to share the content and have obtained consent from identifiable individuals where required.
• We may edit, anonymise, or modify content before public or promotional use.
• You may request removal by contacting us; previously published material may continue to exist where removal is not reasonably possible.
• Public submissions are not treated as confidential.

6. User Conduct

You agree and confirm that you will:

1. Use Bachpankart only for lawful purposes and in compliance with applicable laws.
2. Provide true, accurate, complete, and current information when requested; we may verify details and reject registration or deactivate accounts if information is false or misleading.
3. Compensate us for extra redelivery costs arising from your error (e.g. wrong name or address).
4. Use your best judgment before entering transactions; you do so at your sole risk.
5. Be bound by conditions of sale stated in product descriptions after placing an order.

You may not use the Site to:

• Disseminate unlawful, harassing, abusive, threatening, harmful, vulgar, obscene, or objectionable material.
• Transmit material that encourages unlawful conduct or constitutes a criminal offence.
• Gain unauthorised access to other systems.
• Interfere with another person's use of the Site.
• Breach applicable laws or disrupt networks connected to the Site.
• Copy or store copyrighted material without permission of the owner.

Product images and colours

We endeavour to display accurate product images; however, what you see depends on your device and we cannot guarantee that colours or details on screen match the physical product exactly.

Electronic communications

When you visit the Site or email us, you consent to receive communications from us electronically. We may communicate by email or notices on the Site. Electronic communications satisfy legal requirements that such communications be in writing where applicable.

7. Other Terms

Reviews, feedback, and submissions

Material you post on the Site (including reviews and messages) is generally public. Unless a specific page states otherwise, you grant Bachpankart a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate, and distribute your content in any media. You grant us the right to sublicense these rights. Other users may view content you post for personal use. We do not undertake to monitor all user content but are not responsible for content submitted by users.

Copyright and trademark

Content on this Site is our property or used under licence. Copying, distributing, transmitting, deep linking, or modifying the Site without our express written permission is prohibited and may result in civil or criminal liability. You may download or print copyrighted material for personal use only. Trademarks on the Site are not in the public domain. Submitting material without rights to copyrights or trademarks makes you solely liable for resulting harm.

Indemnity

You agree to defend, indemnify, and hold harmless Bachpankart, its directors, officers, employees, and agents from claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your actions or inactions, breach of these Terms, violation of law, or infringement of third-party rights. This clause survives termination of these Terms.

Termination

We may terminate this agreement or any account at any time. We may terminate passwords or accounts for conduct we consider unacceptable or for breach of these Terms. Termination does not affect your obligation to pay for products already ordered. Our rights in user content survive termination.

Limitation of liability and disclaimers

The Site is provided on an "as is" basis without warranties of any kind. You bear risks associated with use of the Site. We are not responsible for errors or omissions in third-party content or for technical problems you experience. Product warranties, if any, are as stated by the manufacturer on the product page.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits or data. Our total liability to you for claims arising from these Terms or use of the Site is limited to the value of the product(s) you ordered giving rise to the claim, except where applicable law requires otherwise.

As a limited-liability entity, we have an interest in limiting personal liability of our officers and employees. You agree not to bring claims personally against our officers or employees in respect of losses connected with the Site.

Site security

You may not violate or attempt to violate Site security, including unauthorised access, probing systems without permission, interfering with service, spreading viruses, spamming, or forging headers. Violations may result in civil or criminal liability. We may investigate and cooperate with law enforcement. You agree not to use automated tools to navigate or search the Site except through our provided search and standard browsers.

Suspicious communication

Bachpankart does not run contests requiring payment through unofficial links or bank details for lotteries or prizes. Do not trust communications using our branding that ask for payment or sensitive data. We will never email or call you to disclose or verify your password, card number, CVV, or bank account for routine purposes. Do not open attachments or click links in suspicious messages. If you shared sensitive information, update your password and contact us and your bank if needed. Use only customer care details on our official Website.

Modification of terms

We may change these Terms and our Privacy Policy at our discretion; you may not receive individual notice. Re-read these Terms periodically. Continued use after changes constitutes acceptance.

Miscellaneous

• Force majeure: We are not liable for delay or failure due to events beyond reasonable control, including natural disasters, government action, labour disputes, or technical failures.
• Entire agreement: These Terms and policies referenced herein constitute the entire agreement regarding the Site.
• Waiver: Failure to enforce a provision is not a waiver of that or any other provision.
• Severability: If any provision is held invalid, remaining provisions remain in effect.
• Governing law: These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in India, at our principal place of business unless otherwise required by law.
• Payment decline: We are not liable for loss arising from decline of payment authorisation, including preset limits agreed with your bank.

8. Cancellation Policy

9. Account Deletion

If you delete your account, you may lose access to profile information, order history, saved addresses, wishlists, reviews, and other data associated with the account. Wallet or promotional credits, where applicable, may be forfeited upon deletion; we recommend using or withdrawing balances before deletion where options are available.

If you register again after deletion, you will be treated as a new customer without historical data from the deleted account.

We may retain certain information as required for legal, tax, or compliance purposes, including order and transaction records, for the period required by applicable law.
